The SZN Referral Program (the “Referral Program” or the “Program”) is offered by Watch With Friends, Inc. ("The SZN," "The Service", we," or "us") and provides the opportunity to refer your friends, colleagues and associates to The SZN and receive compensation.
The SZN will award a The SZN account credit (the “Reward”) to any Eligible Referrer (as defined below) who refers an Eligible New Customer (as defined below) in compliance with these Referral Program Rules (the “Rules”). The current Reward offer and any Reward amount earned will be listed on your Friends page - theszn.com/friends. The Reward will be issued to the Eligible Referrer within ninety (90) days after The SZN receives full Membership payment from the Eligible New Customer provided that the Eligible New Customer’s account is active and in good standing. In certain instances, The SZN may require a W-9 tax form to be completed by the Eligible Referrer and submitted to The SZN; if the W-9 tax form is not completed within sixty (60) days, the Reward shall be forfeited. The Program cannot be combined with any other offers. The SZN reserves the right to add, modify and/or delete any Rewards and/or requirements to receive any Rewards. The SZN’s decision with respect to all aspects of the Referral Program is final and binding.
To qualify as an Eligible Referrer, you must be a The SZN Authorized Account Holder (as defined in the Master Terms), and your account must be in good standing at the time of the referral. Existing The SZN Members, as well as former The SZN Members, are prohibited from referring themselves. The Eligible Referrer cannot resell The SZN services and doing so may result in immediate disqualification.
An “Eligible New Customer” is an individual who (1) is not currently, and has never previously been, a The SZN Paid Member in any capacity; (2) signs up for a The SZN Paid Membership when The SZN Paid Membership requires payment and while this Referral Program is still active; (3) is an Authorized Account Holder (as defined in the Master Terms); and (4) is not granted a refund on their Paid Membership during their first Membership cycle. Former The SZN Paid Members are prohibited from qualifying as an Eligible New Customer.
You agree not to abuse any The SZN resource, online registration mechanism or the tools in the Referral Website by conduct which is, or can be, interpreted to be detrimental to the brand, trademark or interests of Watch With Friends, Including without limitation, attempting to make referrals or receive rewards in a manner inconsistent with these Rules or the intent of these Rules, attempting to earn rewards through illegitimate channels, participating in fraud, or tampering with Referral Program or its tools.
To get credited for a Referral, an Eligible New Customer must use your referral code during signup, and then become a Paid Member at some point after having used your referral code to sign up. Referral codes may not be added after a Customer signs up. Your referral code will always be listed on your Friends page - theszn.com/friends.
The SZN may offer different Rewards over time. Possible rewards include a one-year free membership, lifetime free membership, and a monetary payout. When to begin, pause, or discontinue Reward offerings is at The SZN's sole discretion. Members will generally be made aware of Reward offering introductions or changes both by email and on the Site.
The SZN may offer a lifetime free membership Reward for accumulating a specified number of Referrals. Once earned, this Reward is valid only for the membership level currently being offered. If The SZN expands current membership offerings, any previously earned lifetime free membership Rewards may not apply to parts of the expanded offering. If The SZN creates new membership offerings - for different sports, for example - any previously earned lifetime free membership Rewards may not apply to these new offerings.
The SZN makes no guarantees about the continuation of The Service. If The SZN chooses not to offer The Service in the future, nothing is owed and there is no obligation to lifetime free membership Reward earners.
If the Eligible Referrer is eligible to participate in this Referral Program, when the value of the referral payout reaches Six Hundred Dollars ($600.00) or more in a calendar year, you must provide updated address and social security details to The SZN so that a 1099 tax form can be generated for tax reporting purposes. These details will be used to allow The SZN to comply with tax regulations and may be shared with appropriate tax authorities. You, not The SZN, are responsible for filing and paying applicable state and federal taxes. The SZN does not provide tax advice, nor should any statements in this agreement or on the Service be construed as tax advice.
By participating in the Referral Program, you agree to release, discharge, indemnify and hold harmless The SZN, its parent, subsidiaries, affiliates, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees and agents (collectively, “Released Parties”) from any liability or damages which may arise out of participation in the Referral Program or out of the acceptance, use, misuse or possession of any Reward or products attained through this Referral Program. You further agree not to: (a) bind, create any obligation (express or implied) or negotiate prices or other terms and conditions on The SZN’s behalf (nor represent to any person, including any prospective The SZN customer or New Eligible Customer, that you have authority to do so). Moreover, you also agree that any promotion methods that you use to promote The SZN products and services to prospective The SZN customers shall be in accordance with all applicable laws and regulations. All applicable federal, state, and local laws and regulations apply.
The SZN MAKES NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO ANY SERVICES OR PRODUCTS CONTEMPLATED BY THIS AGREEMENT. The SZN DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, TITLE AND MERCHANTABILITY.
By participating in the Referral Program, you agree, affirm, and represent that you have read and understand these Rules. In addition, you affirm and represent that you have complied with all the Rules, as well as The SZN’s Terms of Use (as applicable), and have not committed any fraud or deception in entering the Referral Program.
NEITHER The SZN, NOR ITS AFFILIATES, SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF REVENUE, EVEN IF The SZN HAS BEEN INFORMED IN ADVANCE OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE REASONABLY BEEN FORESEEN BY The SZN. THE PARTIES ACKNOWLEDGE AND ACCEPT THE REASONABLENESS OF THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH IN THIS PROVISION.
